- Description: This thesis analyses conflicts in the role of business as a social partner in the South African economy by studying skills development in the Border-Kei Region. Skills development is a key component of the South African government’s programme of labour market regulation and is founded on a participatory approach. The skills development framework requires the participation and co-operation of multiple social partners but relies heavily on the role of business in the attainment of national and sectoral skills development objectives. Unfortunately, however, there are significant conflicts in the role which business is expected to play which consequently hinder the efficiency of the framework and the likelihood that that these objectives will be realised. One of the most pertinent examples of these conflicts is the voluntary nature of the skills development framework, which incentivises but does not compel organisations to invest in training and development. Other conflicts include dissonances between national and employer led strategies and organisational disincentives to engage in training and development. This qualitative study uses an interpretive approach to study how and to what extent the Skills Development Act is implemented in selected organisations in Buffalo City as well as studying the issues pertaining to the implementation process. By using a purposive sampling approach, this research includes both primary data in the form of semi-structured interviews and secondary data in the form of documentary sources. The data represents the perspectives of business, labour and government and provides significant depth of insight into the discussions and issues surrounding skills development in Buffalo City. This dissertation argues that South Africa’s vocational training system, institutionalised through appropriate legislation, may not be sufficient to mobilise social partners, and of primary concern in this research – business – to invest in skills development. It suggests that extensive reliance on business is an insufficient way in which to upskill the labour market. However, with few alternatives to this approach, it is subsequently essential that business is encouraged to buy into the collective interest of skills development objectives. This primarily entails overcoming the challenges that embody the framework and increasing state emphasis on skills development.

In order to deal with this question, the article analyses the treatment of freedom of conscience and conscientious objection by comparing the solemnization of same-sex marriage by public servants, with another public service: that of terminations of pregnancy. While each situation will inevitably turn on the particular circumstances of the case, I argue that there should be a content-neutral guiding principle (as well as consistency) in dealing with these situations. The issue in each situation is narrowed to whether a civil servant’s personal convictions can override the state’s secular obligations in providing a service, and whether there is room for a qualified right to conscientious objection. Considerations for implementating market based mechanisms in combating climate change in South Africa

- Description: Since the first period of the Kyoto Protocol, there has been a growing concern that the burden of reducing greenhouse gas emissions should not only be borne by developed countries, but developing countries as well. South Africa, as the 18th highest emitter of greenhouse gases in the world and highest in Africa, has a significant responsibility to reduce its emissions levels. The South African government is currently in the process of implementing a carbon tax for its short term response to climate change and considering the implementation of a carbon market as a medium to long term response to climate change. Both of these market based mechanisms are widely deemed effective in the mitigation of greenhouse gas emissions by economists, however are also known to have negative social and economic implications upon an economy. This study identifies these implications and attempts to provide considerations on how to alleviate the implications through the most appropriate process of revenue recycling. The negative effects of Implementing a carbon tax or carbon market could be severe as and not limited to: a significant decline in GDP, a reduction in the standard of living for certain households, a fall in a country's exports and even an increase in poverty. South Africa's environmental and development policies place a strict precedence on the protection of the poor and the prevention of economic hardship induced by such policies. This places significant importance on the prevention of these externalities from occurring. A primary means of doing so is through the process of revenue recycling, however, certain channels of revenue recycling are by no means helpful, hence the most appropriate channel needs to be identified. The study carried out a multiple case study analysis on Ireland, Mexico, New Zealand and Norway, to determine what effects a carbon tax had on their economies and how these effects were mitigated through carbon tax revenue recycling. An additional analysis of the EU ETS was carried out to determine how the EU ETS was implemented and the controversies and concerns that arose during its implementation. The findings of this analysis were then compared to a number of South African economist’s case studies, and the most appropriate method of revenue recycling identified and possible solutions to the EU ETS controversies found. The study concludes that a food subsidy has the potential to provide positive effects on welfare employment and GDP; therefore could be considered to be the most appropriate method of revenue recycling. However, these effects are limited to be experienced only at low levels of a carbon tax, hence, short term in nature. The study therefore provides a further consideration that the use of multiple channels for revenue recycling needs to be explored that could provide stable longer term effects. In addition, in the implementation of a carbon market, the study concludes that government should consider using an auction approach in the initial allocation phase of an ETS and the use of a centralized registry for monitoring and controlling of information and transactions.

Alarm cues associated with predation have been shown to have population level effects on certain zooplanktonic species. As such, we assessed the occurrence of such effects on population dynamics of P.longipatella over a 12 day period. Using experimental in situ mesocosms, we compared P.longipatella adult, copepodite and nauplii numbers between three treatments; one inoculated with conspecific alarm cues, one containing direct predation pressure (zooplanktivorous fish), and a control treatment containing no predation threat. Trends in population abundances were similar between the direct predation and alarm cue treatments for the six days of the experiment, decreasing in abundance. During the latter half of the study, however, P.longipatella abundances in the alarm cue treatment increased, while those in the presence of direct predation continued to decrease. In the treatment absent of any predation threat, P.longipatella abundances increased consistently over time for the duration of the study. We suggest that P.longipatella are indeed sensitive to conspecific alarm cues associated with predation threat. Furthermore, we propose that prolonged exposure to conspecific alarm cues in the absence of any real threat results in a reduction in sensitive to these cues.

The primary purpose of this study is to investigate the current consumer perceptions of the three private label brands at Pick n Pay Stores, a South African retailer. Consumers are no longer being presented with a single private label brand, but individual grocery retailers offer multiple private label brands under one retailer. Pick n Pay Store’s current private label brands co-exist as PnP no name, PnP and PnP Finest, and are synonymous with the generic, classic, and premium private label brand concepts, respectively. The question can thus be posed whether consumers perceive private label brands differently and whether they will eventually purchase the private label brand. The research explores the subject of brand, and the nature and success factors of private label brands in retail. This was done by reviewing the literature that traced the rapid changes in the retail sector because of the increasing influence of private label brands on conventional retail practices and consumer behaviour. A conceptual framework was developed showing the constructs that may have relationships with the three private label brands of Pick n Pay Stores. Information regarding the different private label brand concepts was obtained from primary as well as secondary research. An empirical study of a quantitative nature in the form of a paper-based and online-based questionnaire was undertaken. Altogether 375 usable questionnaires were collected. The results of the empirical study indicated positive relationships of perceptions between all three of the Pick n Pay private label brands and their respective intention to purchase. Furthermore, there was a statistically positive relationship between the brand perceptions of Pick n Pay private label brands. The proposed framework is intended to shed light onto the interactions between the private label concepts to allow for meaningful strategic branding decisions to be made at senior business levels.

A conceptual framework was developed showing the constructs that may have relationships with the three private label brands of Pick n Pay Stores. Information regarding the different private label brand concepts was obtained from primary as well as secondary research. An empirical study of a quantitative nature in the form of a paper-based and online-based questionnaire was undertaken. Altogether 375 usable questionnaires were collected. The results of the empirical study indicated positive relationships of perceptions between all three of the Pick n Pay private label brands and their respective intention to purchase. Furthermore, there was a statistically positive relationship between the brand perceptions of Pick n Pay private label brands. The proposed framework is intended to shed light onto the interactions between the private label concepts to allow for meaningful strategic branding decisions to be made at senior business levels.

Unique archaeological evidence found here for the defining attribute of cognitive modernity, as well as coinciding paleo-climatic challenges to survival, both highlight the Cape’s potential to support the existence of pre-historic hunter-gatherers. This habitat, with its unprecedented diversity of geophytes and other plant growth forms, has not yet revealed its potential to provide carbohydrate resources for early Homo sapiens sapiens. In order to investigate this potential, an ethnobotanical survey of the south Cape coastal area near Still Bay was conducted. Despite 17th Century colonialism marking the onset of indigenous plant knowledge decline, the 18 people of Khoe-San descent interviewed in this survey still actively used 58 indigenous edible plant species with a variety of 69 uses. Fruit showed the highest popularity of plants used (52 percent) followed by nectar, with plants having underground storage organs (USOs) ranking third (34 percent). Among growth forms, shrubs dominated (34 percent) followed by geophytes and trees (both 21 percent). With the exception of Prionium serratum, which was rare in the research area, this study failed to identify species that could have formed a staple source of carbohydrate for pre-colonial Khoe-San peoples of the Cape south coast. While eight species of USOs were identified (12 percent of total) only Cyphia species emerged as an important carbohydrate source. This study indicated the importance of Thicket Biome species as a source of edible plants. The second component of the study comprised a two year phenological survey of indigenous edible plant species in four primary vegetation types. A total of 32 USO species and 21 species with aboveground edible carbohydrates (fruiting species) were identified across all sites. Limestone Fynbos had the richest flora of edible species (21 USO species and 18 fruiting species), followed by Strandveld (15 USOs and 13 fruiting species), Renosterveld (8 and 8, respectively) and lastly Sand Fynbos (5 and 5, respectively). The season of highest apparency showed slight variation amongst the four sites over the two years, with more variation evident in the period of apparency. The first survey year had below average rainfall, while the second year received an average rainfall amount. The second year saw a dramatic increase in apparency of abundance for all sites (50 to 60 percent increase) except for the Sand Fynbos site, which showed little change. The other sites showed a one month increase in the period of apparency in the second survey year. Overall, late summer to autumn was the period of lowest apparency of USOs. The ripening of certain fruiting species during this time would have provided a source of carbohydrate when USO availability was at its lowest. Strandveld had the highest biomass in the peak of apparency (over 80 kgha-1) in the first year with a nearly 20 percent increase for the second year. The combined biomass for the four study sites in the first survey year was roughly 150 kgha-1 and 185 kgha-1 for the second year. The apparency of abundance (ripe and edible phase) of fruiting species did not increase much for Renosterveld and Strandveld in the second survey year, except for Limestone Fynbos (49 percent increase) and Sand Fynbos (53 percent). A multivariate analysis showed seven phenophases for high apparency of edible USOs and ripe fruit across the four vegetation types. Given the contribution of evergreen USOs and fruiting species, there would always have been carbohydrates available for foragers to collect in the major vegetation types of the south Cape coast. However, harvesting and processing this carbohydrate resource would have posed cognitive challenges for MSA hunter-gatherers, given the interwoven taxonomic complexity of numerous toxic plant species, and the diverse phenology of edible plant species within the varied vegetation types. These challenges were undoubtedly mastered, highlighting the Cape environment as a possible catalyst to improved human cognitive maturity.

- Description: Arising from Marxist theory, critical theory investigates the mechanisms that enable continued domination in capitalist society, with a view to revealing the real, but obscured, nature of social relations and enabling these to be challenged by subjugated classes. Within the broad spectrum of Marxist theory, social relations of domination and subordination are assigned according to the relationship of social classes to economic production. However, the neo-Marxist perspective developed by Antonio Gramsci locates relations of power within the broader context of the political economy. In doing so, the role of the State in a capitalist society assumes greater significance than that of maintaining and securing social relations on behalf of the dominant class through coercion and force. Instead, the State embarks on a range of activities in the attempted “exercise of hegemony”, or the cultivation of general acceptance by all social classes of existing social relations and conditions. Gramsci refers to this desired outcome as “consent”, the product of the successful exercise of hegemony, a political function which is thus crucial to the accumulation of capital. When unsuccessful, dissent cannot be contained by the State, and the extent to which contestation constitutes a threat is revealed by recourse to coercion. The manner in which relations of power are cemented through the exercise of hegemony lies at the core of this thesis. It investigates the relationship between the State and the administrators of an institution within civil society, the University of Fort Hare, as well as the responses to the activities of the State and University Administration within the University itself, over an extended period of time between 1916 and 2000. This period is divided into three specific time frames, according to changes in the expression of the South African State. In general, it is seen that conformity characterises the relationship between the State and the University Administration, underscoring the success of the State in fostering the role of education in the reproduction of social relations and values and in eliciting conformity. The nature of conformity is seen to vary according to different expressions of the State and changes in social relations, which are in turn informed by the overarching political economy and events taking place within society and the University of Fort Hare. Coordinating legal aid services in civil matters for indigent people in eThekwini: a model for improved access to justice

This thesis focuses on ‘legal aid’ service delivery (broadly speaking) for the indigent in a particular locality by and through registered law clinics, other legal services providers and via other means in civil rather than criminal matters. In this regard there continue to be very substantial differences between the proper access to civil justice requirements of constitutional South Africa and the actual situation which has existed since the dawn of South Africa’s democratic era which continues unabated. Justice and equality are promised to all in South Africa, yet due to gaps in the ‘net’ of free legal services provided to the indigent, the ability to pay for legal services in civil cases often remains the deciding factor. This study examines the constitutional obligations which, it is argued, apply to the provision of free civil legal services to impoverished people in South Africa. This research considers the law as a vector for necessary positive transformation in the daily lives of those resident in South Africa, which is considered within the country’s woefully unequal socio-economic situation. It builds upon existing research and court authority which show the function of access to justice as an important promoter of the type of society envisaged by the South African Constitution - one where the enjoyment of justice and equality are within the reach of all. However, at present, if one can afford the expensive services of lawyers in civil matters, then access to justice is far more readily attainable. But the opposite is true where someone is denied meaningful access to justice through a lack of legal representation because they cannot afford prohibitively high lawyers’ costs (and disbursements) and no adequate alternatives are provided for by the state or through other means. In these circumstances a vulnerable, unrepresented litigant in a civil case faces a greatly increased likelihood of being denied proper access to a daunting and intricate legal system. There are two main reasons for concentrating on free legal services to the ‘needy’ in civil rather than criminal matters. In the first place, all available statistics show that a huge proportion of legal aid services in South Africa has been and continues to be dispensed in criminal rather than civil cases. Secondly, there has been minimal research or case authority in South Africa on legal aid and other free legal services for impoverished people in civil matters. This thesis examines the state of free civil legal service provision and the need for such assistance within the eThekwini Metropolitan Municipality, one of South Africa’s largest metropoles. This analysis includes an empirical study of the requests for free civil legal services in a particular year by qualifying potential clients in eThekwini and the degree to which free legal service providers are meeting or failing to meet those needs. The study considers the legal service provision in such matters by legal non-governmental organisations, state-supported legal service providers and the work of legal professionals in private practice acting pro bono. The thesis then proposes a model for eThekwini for coordinating (and concurrently improving) civil legal aid services, pro bono legal work and other forms of free legal assistance - like community service by senior law students and law graduates - in response to the particular needs and circumstances facing the indigent there. When referring to the concept of ‘legal aid services’, this research concentrates on legal advice, assistance and representation to indigent clients. However, the promotion of legal rights awareness to such clients is often necessary to open their eyes to the possibility of legal avenues, where appropriate, to improve their situations. Therefore this study also considers - albeit to a lesser degree - this more indirect form of legal assistance through the dissemination of legal knowledge in an accessible form to clients who would qualify for legal aid assistance. Making use of social media can therefore also play a role in coping with relationship dissolution, both at the time of the dissolution and during the post-dissolution stages of the romantic relationship. Lazarus’ Stress and Coping Theory, as well as aspects of Social Interactionist Theory, were utilised as a theoretical framework to conceptualise coping strategies and online behaviour. The aim of the study was to create a detailed description of the role of social media in coping with relationship dissolution. The study was a qualitative, phenomenological study and participants were obtained using purposive and snowball sampling. Unstructured, in-depth interviews were used to collect the data. Thematic analysis was used to analyse the data. Based on the findings of the researcher, social media can be both advantageous and disadvantageous in coping with relationships dissolution. Moreover, using social media in order to cope during and after relationship dissolution indicated adaptive coping in the short-term, and maladaptive coping in the long-term. This study has therefore generated an understanding of the role of social media in coping with relationship dissolution.

A literature study was conducted on three aspects, which are core self-evaluations, stress and work aspirations. This was followed by a survey involving 250 education specialists from four selected districts in the Eastern Cape, which are, Dutywa, Butterworth, Fort Beaufort and Mthatha. Results of the current research indicated that there is a positive relationship between core self-evaluation and DoE stress levels (r=0.32409; p=0.0014). These findings indicate that some individuals have low core self-evaluations due to their exposure to stressful situations hence they negatively appraise themselves and are less confident of themselves. DoE Senior Management Team (SMT) has to strategise and adopt measures that reduce stress levels and encourage positive CSE so as to deal effectively with under-performance.

- Description: Monitoring unused IP address space by using network telescopes provides a favourable environment for researchers to study and detect malware, worms, denial of service and scanning activities. Research in the field of network telescopes has progressed over the past decade resulting in the development of an increased number of overlapping datasets. Rhodes University's network of telescope sensors has continued to grow with additional network telescopes being brought online. At the time of writing, Rhodes University has a distributed network of five relatively small /24 network telescopes. With five network telescope sensors, this research focuses on comparative and correlation analysis of traffic activity across the network of telescope sensors. To aid summarisation and visualisation techniques, time series' representing time-based traffic activity, are constructed. By employing an iterative experimental process of captured traffic, two natural categories of the five network telescopes are presented. Using the cross- and auto-correlation methods of time series analysis, moderate correlation of traffic activity was achieved between telescope sensors in each category. Weak to moderate correlation was calculated when comparing category A and category B network telescopes' datasets. Results were significantly improved by studying TCP traffic separately. Moderate to strong correlation coefficients in each category were calculated when using TCP traffic only. UDP traffic analysis showed weaker correlation between sensors, however the uniformity of ICMP traffic showed correlation of traffic activity across all sensors. The results confirmed the visual observation of traffic relativity in telescope sensors within the same category and quantitatively analysed the correlation of network telescopes' traffic activity.

- Description: In an attempt to have medicines available in patient-ready packs (PRPs) prior to the dispensing process, the provincial medicine depots in South Africa have, for many years, been repackaging bulk medicines into PRPs. Notwithstanding the fact that bulk medicine packages may have been the only packages available from the manufacturers to service the Primary Health Care (PHC) sector, the main aim of this process was to ensure that medicines were available in PRPs for dispensing to patients, thus, minimising the time spent on each prescription by the pharmacist, pharmacist’s assistant or Nurse. Currently, some medicines are being procured in PRPs from the manufacturers, whereas others are still procured in bulk packs which must be repackaged into PRPs. After a thorough literature search, it was established that, up until this point in time, no studies have been performed to compare costs of repackaged medicines from bulk packs with costs of medicines procured from manufacturers in PRPs. There was very scanty literature comparing the use of medicines procured either in PRPs or bulk packs. Methods: Survey research was conducted with respondents drawn from a range of schools in Buffalo City, South Africa. Multi-stage sampling was used, namely stratified random sampling of schools and purposive sampling of grades used within schools. The data were collected by means of self-administered questionnaires in group situations. Results: Results indicate that knowledge of the legal status of abortion, as well as of the various stipulations of the law, was poor. Various misunderstandings were evident, including that spousal approval is required in order for married women to have an abortion. Significant differences between the knowledge of respondents at the various schools were found, with those learners attending schools formerly designated for African learners during Apartheid having the least knowledge. Conclusion: Given the multiple factors that may serve as barriers to women accessing abortion, it is imperative that at least the most fundamental aspect of reproductive rights, that is, the right to information, is not undermined.
