- Description: This thesis explores the meaning and experience of the bodily states associated with the condition referred to as myalgic encephalomyelitis (ME). It uses as a theoretical point of departure an understanding of the body as a socially constructed phenomenon and, in so dOing, offers an interpretation of illness that is seen to differ markedly from those offered by the medical and behavioural sciences. Using descriptive narrative research analysis, the thesis attempts to elicit personal trajectories of illness experience. In contrast to biomedical and social trajectories of illness, in which the interpretation and meaning given to the condition are imposed externally, personal trajectories are seen to provide unique subjective accounts of illness experience. And the value of using narrative accounts of illness is seen to lie in their ability to bring to light these individualised versions of illness experience. It is shown, in addition, that these narrative accounts of illness are also valuable in exposing the culturally shared knowledge that is employed in the process of assigning meaning to illness experiences. The aim of the thesis, then, in employing the descriptive narrative research method is to describe these shared cultural schemas. It is suggested that this approach leads to an interpretation of illness experience which sheds light on important links between the body, self and society. It is argued, more specifically, that Western capitalist society is associated with the creation of an "unnatural" environment and social context which is perceived to be inherently damaging and threatening to the well·being of those living in it; and that this assumption is pivotal to the interpretation of the illness experiences narrated and analysed for the thesis. This sociological reading of embodiment provides a basis for understanding the experience of illness, as not one simply embedded in the body or mind of the individual, but as one laden with personal meaning assimilated from, and hence revealing of, the social context in which the illness is experienced. As such, an attempt is made to provide an account of illness experience distinct from the dominant biomedical and behavioural accounts of ME.

- Description: This thesis is a detailed account of Zimbabwe's controversial fast-track land reform programme. Zimbabwe's land reform history has been discussed extensively, with a focus on land redistribution. The fast-track land reform programme transferred eleven million hectares of land from 4 000 white commercial farmers to 51 543 landless peasant families. The thesis begins by offering some land reform theories and gives an overview of the land question in Southern Africa. This is followed by a discussion of Zimbabwe's land question from a historical perspective. Next is a periodised account of the successes and failures of land reform attempts made by the Zimbabwean government from independence in 1980 to 1998 when the fast-track land reform programme was conceived. Zimbabwe's political and economic situation at this time is significant. The context for fast-track land reform includes a discussion about the national question in Zimbabwe and the deteriorating status of white citizenship; the rise of Zimbabwe's liberation war veterans as a formidable force and the formation of the Movement for Democratic Change as a strong political party that was challenging, among others, the dominance of the ruling Zanu-PF party and its policies. The blueprint for fast-track land reform is discussed in order to contrast it to how the reform unfolded in practice. In this regard, the response of the international community to the violence and lawlessness that characterised fast-track land reform is worth mentioning, especially since it has bearing on how Zimbabweans are trying to cope with life in a radically altered physical and social environment, following the land reform exercise. The consequences of fast-track land reform are analysed in terms of development and the plight of Zimbabwe's farm workers; the internal displacement of hundreds of thousands of farm workers, white commercial farmers and others in Zimbabwe's countryside and whether or not fast-track land reform beneficiaries can successfully engage in agriculture to improve their standard of living. The Vumba and Burma Valley case study is illustrative of how fasttrack land reform was implemented and its socio-economic impact on Zimbabwe's poor and marginalised groups, for instance, female farm workers. The case study offers valuable insights about the survival strategies that ordinary people affected by the land reform exercise are adopting in order to cope with their new circumstances. Data was gathered from a focus group discussion (pilot study), in-depth semi-structured interviews and observation on three farms, as well as interviews with a few government officials, government documents and newspaper reports. The study is useful to countries that are planning or already implementing land reform, for example, South Africa.

- Description: A central concern of this thesis is the expansion, distribution and control of 'non-standard' employment in Namibia since independence. The employment relationship has assumed various historical forms under capitalism, each of which corresponds to a specific mode of regulation with distinct structural dynamics. An attempt is made to extend the regulation approach 'downwards' to account for the problem of order in the workplace and to place the employment relationship within its own regulatory framework. The point of departure in this study of the dynamics of labour regulation is the contradictory nature of labour's incorporation, allocation, control and reproduction within the labour market. The employment relationship is never only an economic exchange, but is also mediated through an institutional framework that connects the processes of production and social reproduction, and regulates conflicting interests inside and outside the workplace. This relationship, as critical realists have pointed out, is a product of the indeterminate intersection of several generative structures. The roots of these generative structures can be traced to three sets of social processes: the processes of production and the structuring of labour demand; the processes of social reproduction and the structuring of labour supply; and the forces of regulation. Non-standard employment is viewed as a particular social and spatio-temporal 'fix' for the various regulatory dilemmas generated by the standard employment relationship. This conception underscores the fact that a national system of labour regulation decisively shapes the conditions under which employers are able to casualise a part of their workforce. The differential experience across national boundaries suggests that analytical space needs to be provided for systems of labour market regulation which may either accentuate or moderate pressures for casualisation. Segmentation on the demand side of the labour market is explored through an analysis of the types of non-standard jobs created in different economic sectors. The various forms of employment 'flexibility' tend to vary in importance according to the specific manner in which a firm chooses to compete. Consequently, non-standard employees are distributed in a complex and uneven manner across industrial sectors and the occupational hierarchy, and face a diverse range of possibilities and liabilities that shape their levels and forms of participation in the labour market. By counteracting the homogenisation effects of labour law and collective bargaining, the mobilisation of cheap and disposable labour through non-standard employment contracts allows employers much greater discretion in constructing the wage-effort bargain. With non-standard employment, social and statutory regulation is weak or underdeveloped and hence managerial control is autocratic, with a significant contractual component. Although the changing social composition of the workforce associated with employment 'flexibility' poses serious challenges to the modes of organisation that have long served the labour movement, trade unions in Namibia and elsewhere have been slow to respond to the threats of casualisation. Of concern here, is the extent to which attempts to promote the security of existing union members is compatible with attempts to organise non-standard employees. This thesis shows that the unions have developed a complex amalgam of strategies in their efforts to regulate non-standard employment relationships.

Others who assisted state censorship included religious and cultural interest groups. State censorship in turn put pressure on record companies, musicians and others to practice self-censorship. Many musicians who overtly sang about taboo topics or who used controversial language subsequently experienced censorship in different forms, including police harassment. Musicians were also subject to anti-apartheid forms of censorship,such as the United Nations endorsed cultural boycott. Not all instances of censorship were overtly political, but they were always framed by, and took place within, a repressive legal-political system. This thesis found that despite the state's attempt to maintain its hegemony, musicians sought ways of overcoming censorship practices. It is argued that the ensuing struggle cannot be conceived of in simple binary terms. The works of Antonio Gramsci, Michel Foucault and Pierre Bourdieu, in particular, are applied to the South African context in exploring the localized nuances of the cultural struggle over music censorship. It is argued that fragmented resistance to censorship arose out of the very censorship structures that attempted to silence musicians. Textual analysis brought to light that resistance took various forms including songs with provocative lyrics and titles, and more subtle means of bypassing censorship, including the use of symbolism, camouflaged lyrics, satire and crossover performance. Musicians were faced with the challenge of bypassing censors yet nevertheless conveying their message to an audience. The most successful cases negotiated censorial practices while getting an apparent message across to a wide audience. Broader forms of resistance were also explored, including opposition through live performance, counter-hegemonic information on record covers, resistance from exile, alignment with political organizations and legal challenges to state censorship. In addition, some record companies developed strategies of resistance to censorship. The many innovative practices outlined in this thesis demonstrate that even in the context of constraint, resistance is possible. Despite censorship, South African musicians were able to express themselves through approaching their music in an innovative way.

Rights-based restitution in South Africa : developmental land reform or relocation in reverse?

- Description: The main question of this thesis is to what extent the rights-based and market-driven nature of the restitution program has given rise to a legalistic and bureaucratic process that negates both the demand-driven and the developmental aspects of restitution as land reform. I answer this question by showing that the choice of a Constitutional model with a Bill of Rights provides the background for a rights-based land reform program. This is especially true for the restitution sub-program, one of the three branches along with redistribution and tenure of the overall land reform program. I then consider the debate around the property clause, and how its inclusion provided the context for a market and rights-based approach to land reform as opposed to a supply-led administrative approach. Because the property clause as a First Generation right prevents expropriation of land without market-related compensation, a complex and legalistic land reform program falling within the ambit of Second Generation rights was formulated to address the gross imbalance in land ownership in South Africa. I argue that the contemporary origin of Second Generation human rights lies within the context of class and anti-globalisation struggles for democracy, and that they are something to be fought for and defended. I discuss the distinction between First, Second and Third Generation rights and identify four spheres within which the struggle for Second and Third Generation rights takes place within modern democratic states. These are the state, the representative public sphere, civil society and the private sphere. I then deal with the problem of trying to turn "paper rights" into realisable rights for the more disadvantaged sectors of society. I also look at what impedes their realisation. I argue that a number of strategies are necessary to ensure the delivery of Second and Third Generation rights. These are an adequate legislative framework, a good communication strategy, the development of institutional capacity to deliver, and if all else fails, access to conflict resolution mechanisms. I consider the major impediments to the realisation of Second and Third Generation rights to be the way in which they are defined in relation to First Generation rights, especially the property clause, the way in which access to rights-backed resources through formal institutions are mediated by the operation of informal institutions, and the dearth of administrative competence in South Africa. My point is that in order for Second and Third Generation rights to have practical benefit for the dispossessed and poor, extraordinary measures are needed. The Restitution arm of the land reform program provides in theory just such extraordinary measures, albeit for only a section of the population. I analyse the effectiveness of the Land Claims Court in assisting restitution claimants and the rural poor to realize their rights. I trace the slow and haphazard shift from a positivistic statutory interpretation (narrow, literal, legalistic) to a purposive interpretation (informed by the Constitutional spirit and social purpose of the legislation) by the Court. This is followed by an analysis of the restitution business process, which means tracing the path of the claim from lodgement to settlement. I set out the costly, complex and legalistic implementation and policy process in some detail. My argument is that in order for a rights-based approach to overcome the impediments outlined in Chapter 3, as well as the property clause in the Constitution, its architects designed a complex process that in the end proved counter-productive in terms of its original aims. The failure of the process to deliver led in 1998 the then Minister of Land Affairs, Derek Hannekom, to appoint a Ministerial Review to investigate the problems. Problems included: slowness of delivery, the crisis of unplannability, low levels of trust between implementers, and high levels of frustration. Two issues are analysed more fully, the rights-driven approach as opposed to the rights-based approach and the lack of claimant participation in taking control of the restitution process. I examine the relationship of the Restitution Commission to the Department of Land Affairs and to municipal land use planning processes. The emphasis on rights within the restitution program had the effect of distancing restitution, especially in the first few years of the programs' existence, from the rest of the land reform program, as well as from the local government process of formulating land development objectives (LDOs), and the Integrated Development Planning (lOP) process. I look at the Port Elizabeth Land and Community Restoration Association (Pelcra) as a case study as it embodies an approach that tries to move beyond a mere reclaiming of rights in land and attempts to implement a developmental approach. I conclude that the rights-based restitution program in spite of its many shortcomings has had some success. It has moved slowly from an overly legalistic judicial program to a more administrative but still bureaucratic process, that has delivered only 27 percent of its product as land reform, the rest going to monetary compensation mainly in urban areas. Thus it can be argued that restitution has been more successful as a program to promote reconciliation along the lines of the Truth and Reconciliation Commission, than as a land reform program, especially if one regards land reform as the restoration of rural land to the indigenous population. There have also been some successful attempts by the Commission, such as in the case of PELCRA, to integrate the processing of its claims with local government planning processes, but progress in this direction remains patchy.

- Description: The main question of this thesis is to what extent the rights-based and market-driven nature of the restitution program has given rise to a legalistic and bureaucratic process that negates both the demand-driven and the developmental aspects of restitution as land reform. I answer this question by showing that the choice of a Constitutional model with a Bill of Rights provides the background for a rights-based land reform program. This is especially true for the restitution sub-program, one of the three branches along with redistribution and tenure of the overall land reform program. I then consider the debate around the property clause, and how its inclusion provided the context for a market and rights-based approach to land reform as opposed to a supply-led administrative approach. Because the property clause as a First Generation right prevents expropriation of land without market-related compensation, a complex and legalistic land reform program falling within the ambit of Second Generation rights was formulated to address the gross imbalance in land ownership in South Africa. I argue that the contemporary origin of Second Generation human rights lies within the context of class and anti-globalisation struggles for democracy, and that they are something to be fought for and defended. I discuss the distinction between First, Second and Third Generation rights and identify four spheres within which the struggle for Second and Third Generation rights takes place within modern democratic states. These are the state, the representative public sphere, civil society and the private sphere. I then deal with the problem of trying to turn "paper rights" into realisable rights for the more disadvantaged sectors of society. I also look at what impedes their realisation. I argue that a number of strategies are necessary to ensure the delivery of Second and Third Generation rights. These are an adequate legislative framework, a good communication strategy, the development of institutional capacity to deliver, and if all else fails, access to conflict resolution mechanisms. I consider the major impediments to the realisation of Second and Third Generation rights to be the way in which they are defined in relation to First Generation rights, especially the property clause, the way in which access to rights-backed resources through formal institutions are mediated by the operation of informal institutions, and the dearth of administrative competence in South Africa. My point is that in order for Second and Third Generation rights to have practical benefit for the dispossessed and poor, extraordinary measures are needed. The Restitution arm of the land reform program provides in theory just such extraordinary measures, albeit for only a section of the population. I analyse the effectiveness of the Land Claims Court in assisting restitution claimants and the rural poor to realize their rights. I trace the slow and haphazard shift from a positivistic statutory interpretation (narrow, literal, legalistic) to a purposive interpretation (informed by the Constitutional spirit and social purpose of the legislation) by the Court. This is followed by an analysis of the restitution business process, which means tracing the path of the claim from lodgement to settlement. I set out the costly, complex and legalistic implementation and policy process in some detail. My argument is that in order for a rights-based approach to overcome the impediments outlined in Chapter 3, as well as the property clause in the Constitution, its architects designed a complex process that in the end proved counter-productive in terms of its original aims. The failure of the process to deliver led in 1998 the then Minister of Land Affairs, Derek Hannekom, to appoint a Ministerial Review to investigate the problems. Problems included: slowness of delivery, the crisis of unplannability, low levels of trust between implementers, and high levels of frustration. Two issues are analysed more fully, the rights-driven approach as opposed to the rights-based approach and the lack of claimant participation in taking control of the restitution process. I examine the relationship of the Restitution Commission to the Department of Land Affairs and to municipal land use planning processes. The emphasis on rights within the restitution program had the effect of distancing restitution, especially in the first few years of the programs' existence, from the rest of the land reform program, as well as from the local government process of formulating land development objectives (LDOs), and the Integrated Development Planning (lOP) process. I look at the Port Elizabeth Land and Community Restoration Association (Pelcra) as a case study as it embodies an approach that tries to move beyond a mere reclaiming of rights in land and attempts to implement a developmental approach. I conclude that the rights-based restitution program in spite of its many shortcomings has had some success. The new policy framework in South Africa, known as the irrigation management transfer, is premised on the transfer of ownership, authority and responsibility of small-scale irrigation schemes from government to the farmers. Tyhefu irrigation scheme was a state-driven, top-down initiative. This study argues that the justifications for the Tyhefu irrigation scheme were conflated, with the result that the need for political control of the Tyhefu area far outweighed the considerations regarding the financial viability and sustainability of the proposed project. Given the repressive political climate of the time in South Africa, the planners' proposals were a mechanism for the realization of the socio-political and economic agendas of the apartheid state and Ciskei government. Although technical factors critical for project success were examined, little or no attention was paid to the socio-economic aspects. For the planners, the main requirements for success entailed centralized managerial control, no participation of the beneficiaries, capital intensive and sophisticated agricultural techniques and the production of high value crops. Therefore, it can be argued that the nature of the planning and implementation of the Tyhefu irrigation scheme was ill-conceived, short-sighted and misguided. A review of the literature on irrigation development on the African continent provided useful insights for this study. The lessons from irrigation development experience in Sub-Saharan Africa indicate that the continent is littered with examples of derelict and costly failures. What stands out in many of these irrigation projects is their over-emphasis on technical issues to the complete neglect of human and other social aspects. Working partnerships between the farmers and irrigation scheme management could, thus, not be realized. Almost without exception the case studies used here indicate that the industrious type of farmer was never developed as was envisioned in the planning documents. Neither were rural livelihoods improved in a sustainable manner. The findings of this study suggest that irrigation management transfer is a complex and delicate process. To examine the contribution made by the small-scale fisheries towards rural development in the villages, it is imperative to have an understanding of the context in which they were established as well as the prospects for sustainable development. It is argued in this study that despite the significant contribution made by inland rural fisheries in improving rural livelihoods they are still accorded minimal support and attention in South Africa. As an illustration of the important role played by rural fisheries, case studies from Malawi and Zimbabwe have been drawn into the study with a view to providing lessons for rural areas of South Africa. The study took place at a time when natural resources in the villages were significantly declining and environmental degradation reaching uncontrollable proportions, so there is an urgent need to secure an alternative mode of subsistence for the population in the villages. Development interventions by the state and non-governmental organisations in the study area have not been sustainable and they collapsed within a short period of time. A case in point is the Tyefu irrigation scheme, which was initiated in the villages but, owing to various factors, it failed leaving the villagers with a diminished mode of subsistence, thus providing the impetus for the implementation of small-scale rural fisheries. In order for small-scale fisheries to be sustainable it is essential to adopt models that are aimed at sound natural resource use and management. This study has raised various issues pertinent to natural resource use and management in the study area. A model for management of natural resources that involves and aims to empower local communities in the management of the fisheries is presented in the study. It has also been demonstrated that rural fisheries in the study area comply with the model. Finally, the study draws the conclusion that small-scale fisheries in the villages contribute towards rural development, however, there are constraints that need to be eradicated.

- Description: During this research, an attempt was made to gain an understanding of management and their employees' perceptions regarding functional and numerical flexibility practices within South African organisations. To achieve this, twenty-six people, comprising of a variability of positions within the organisation, were interviewed in the region of the Western Cape. It was found that, although extensive research on the two forms of flexibility have been globally conducted, South African literature, particularly on the part of numerical flexibility, is limited. It is thus believed that this study will present a valuable basis to pursue in further research. Literature that was consulted was found to be supportive of the theoretical notion that South African organisations, in order to be globally competitive, have had to restructure and redefine themselves by ensuring that they make the most efficient and effective use of their human resources. The study found that whilst functional flexibility practices benefit employees in that they experienced increased job satisfaction and job mobility, it was the area of numerical flexibility which raised many dissatisfactions, including those of immense job insecurity and remuneration, both financial and otherwise. The study findings suggest a need for a more comprehensive and employee integrated approach by combining organisational with individual oriented initiatives, and ensuring the trade union's involvement in all facets of functional and numerical flexibility initiatives. The thesis ends with recommendations of various strategies for addressing the concerns of management, employees and the trade union in order to ensure full and proper utilisation of human resources so that the end product, namely job satisfaction, leads to organisational success.
