The right to adequate housing and its effective implementation in South Africa

- Description: As stated in article 25 of the Universal Declaration of Human Rights (UDHR), the right to access to adequate housing is one of the most fundamental human rights as it informs the right to a decent standard of living. In 1996, the Republic of South Africa adopted a Constitution which sought to secure the right to access adequate housing. Despite the constitutional protection of this right, a number of challenges remain within the South African context where there are a lot of inequalities and a skyrocketing population. Through desktop review and jurisprudential analysis, this study examined if the right to access to adequate housing is being implemented effectively. This was done by looking at the provision of housing during the apartheid era and post 1994 in the new Constitutional era, up to the year 2020. The study has examined the available legal and policy framework for housing, in light of international and regional standards, as well as the strategies and programmes that have been put in place to ensure that everyone has access to adequate housing, and how effective the programmes have been. Such programmes include Reconstruction Development Programme (RDP) housing, subsidy housing and other forms of housing that have been put in place in South Africa. There have been many milestones but there are still a lot of obstacles to overcome. Mass protests and cases brought before South African courts often demonstrate this. The South African government has done a commendable job, but much more needs to be done because the country's population is increasing rapidly. The study then recommends how the challenges can be addressed to promote effective implementation of the right to access adequate housing. This includes a programme where the unemployed youth will be equipped with skills to build and maintain RDP houses, a housing framework of allocating houses based on the number of people in each household and lastly, a system which prohibits fraud within the housing delivery system. , Thesis (MPhil) -- Faculty of Law, 2021

- Description: One of the principles of Reconstruction and Development Programme is that development projects should be people driven. One of the programmes through which such people driven development is meant to be realized is the Enhanced Peoples Housing Process. This research seeks to identify the limitations in the implementation of the Enhanced People’s Housing Policy, to ascertain the involvement of beneficiary communities in the process, and to assess improvement in the quality of life of beneficiaries who have acquired houses. It is argued that these limitations may be attributed to the interpretation and implementation of the Policy Guidelines for the implementation of PHP. The researcher is of the view that development programmes should be participatory and that this will promote empowerment of communities as opposed to the creation of dependency. The researcher has selected two case studies which show that the involvement of communities in planning and decision making does meet the needs and demands of the community for improvement in an efficient and effective way.

- Description: The purpose of this study was to asses the challenges facing the Eastern Cape Nkonkobe Municipality in the provision of adequate housing for the poor. The study also aimed at suggesting mechanisms or strategies that could be applied to remedy the situation. It became evident throughout the study that the government has tried its best to fight against homelessness, but there are still thousands of people who do not have houses. The study was conducted through the use of a combination of the qualitative and quantitative research methods. Multiple methods were used with a view to increasing the reliability of observations. Twenty questionnaires were distributed to people at grassroots and ten questionnaires were distributed to the municipal officials. It has been noted in the study that community participation at all government levels is not taken seriously thus the housing problem in Nkonkobe Municipality. It is evident in the study that all the peoples’ projects in this municipality should be people-driven. It has also been pointed out that the service providers take a big slice of the municipal budget. The National Department of Human Settlement must also increase the budget that is allocated to the local municipalities so as to be able to spearhead housing delivery. This study will make a great contribution to the society in that all stakeholders will devise mechanisms to fight against housing challenges in the Nkonkobe Municipality. The municipal officials will devise workable solutions to the housing problem in Nkonkobe. - Description: The intention of this study was to examine the challenges facing housing service delivery and its impact in Ngcobo Municipality. The study was also focusing on the factors that prevent/hinder the delivery of houses in Ngcobo. In this process the role of the different stakeholders has been identified and it became apparent that the spheres of government do not always complement each other or plan together. There was not a single window of co-ordination and this has resulted in a lack of support by National and Provincial government to the local sphere. The role of politicians and government officials and their lack of understanding of government policies has led to poor housing service delivery. In some instances their inability to work as a collective created tension and a lack of trust on the part of the community. This study has adopted both qualitative and quantitative research methods which are regarded as complementary. The findings that emerged from the study was that this housing service delivery project lacked integrated planning by the stakeholders. It is crucial and would make a significant difference if the Ngcobo Municipality were to review the results of the study and consider implementing its recommendations. - Description: The study investigates problems and challenges that, the Nyandeni local municipality faces in terms of housing delivery to its communities. The purpose is to look at the factors that affect housing delivery at Nyandeni local municipality in the Extension 4 Housing Project in Ngqeleni and what can be done in order to improve it. The housing development at Nyandeni Local Municipality is not up to standard, the situation is worse in rural areas where there is not a single rural housing project that has been implemented thus far instead, there is a lack of infrastructure and other essential services. This is a serious problem that the Nyandeni local municipality faces, as a result the most vulnerable people are the poorest of the poor particularly those residing in rural areas. The study has investigated housing delivery at Nyandeni local municipality with reference to the Extension 4 Housing Project in Ngqeleni. The investigation indicates that there are serious challenges facing housing delivery. Hence the beneficiaries of the project could not get their houses in time and the project could not be completed within the scheduled period.

- Description: Section 26 of the Constitution of South Africa Act 108 of 1996 provides that housing is a basic human right and that the government must take reasonable legislative and other measures to achieve the realisation of this right. A number of measures were taken to try to resolve this socio-economic issue. A number of housing institutions were established , various pieces of legislation were passed and housing subsidies were provided. However, housing backlogs remain a challenge. In March 1994 the housing backlog was estimated between 1,3 and 1,8 million units. When more than a million houses were provided by 2001 , the housing backlog had increased to between 2 and 3 million houses. To date subsidies in excess of R29 billion have been spent on housing provision. A study by the Department of Housing concluded that, at the current rate of increase of housing funding vis-a-vis the growing backlog and rapid urbanisation, the household backlog will not be changed in ten years' time. The United States of America (USA) had a similar low cost housing problem, but securitisation alleviated it with the participation of government agencies Fannie Mae, Ginnie Mae and Freddie Mac. In South Africa, the NHFC tried to emulate the USA model by establishing Gateway Home Loans (Pty) Limited (Gateway) in 1999. Gateway, however, was not a success. This research investigates whether securitisation can be applied in South Africa to alleviate the low cost housing issue. The study finds that there is a credit availability gap for the low income sector earning less than R8 000 per month because of the perceived risk of default and unwillingness by banks to lend to this sector. The increase in housing backlog that continues unabated, inadequate housing finance system to low income earners, the lessons learnt from the failure of Gateway, the success factors of the USA securitisation model and the sound and sophisticated South African financial system are the rationale for applying securitisation. A proposal of how to effectively apply securitisation to low cost housing in South Africa is provided with recommendations to revive the primary market.
