The socio-economic contribution of non-timber forest product trade to households in four villages in Zomba and Machinga Districts, Malawi

- Description: The principal aim of this study was to assess the socio-economic contribution of nontimber forest product (NTFP) trade to households in Zomba and Machinga, southern Malawi. Quantitative and qualitative data were collected through several methods, including a household survey using questionnaire interviews, focus group discussions, key informant interviews with individual traders, direct observations, and literature review. The quantitative data were analysed statistically using SPPS version 16.0 while the qualitative data were analysed thematically. NTFP trade was the third important source of cash income for 15% of the households, although the level of use, buying and selling of NTFPs varied across the four study villages. All households in all the study villages used firewood (100%), and most used thatch grass (94%), bamboo (96%), wood for building (92%), largely as construction materials. However, the percentage of households buying NTFPs was lower, with the maximum percentage of households being 50%. The percent of households engaged in selling at least one NTFP was lower still at 39%. Substantial cash incomes were generated from firewood and edible orchids sales which provided up to a maximum of Mk180,000, equivalent to US$456, per year. Households joined the trade mostly for an alternative source of cash income due to poverty and to meet basic needs when other options were not available or feasible. Cash income generated from NTFP trade acted as a safety net and a coping strategy when other avenues supporting livelihoods were not accessible. The socio-economic benefits derived from NTFP trade were associated with the quantities collected, sold, market forces influenced by the law of demand and supply. The small amounts of cash income generated by most households were important as they supplemented household cash needs. There was a strong association between NTFP trade as one of the important sources of cash income and the number of months a household had food from their own garden in a year. There was a significant relationship though weak between ranking of NTFP trade and livestock ownership by households. Value chain analysis was used as an analytical tool to understand the processes involved in NTFP trade. The value chains for the products under study were short, dominated by traders and some intermediaries. Most of the products were sold in local markets with little value addition. This study recommends that policy makers should integrate NTFPs into their development plans, emphasizing the establishment of management strategies that will enhance availability and sustainability of the resource. NTFPs contributed to the livelihoods of the households socially and economically through provision of food, cash income, energy for cooking, medicine and construction materials.

Using interviews, radio programme transcripts and observations, the study found that through using their prior knowledge from a training of trainers’ course on rain water harvesting and drawing on everyday experience of rainwater harvesting the CoP members had an expansion in their mutual engagement, joint enterprise, diversity, shared repertoire and identity into a knowledge community. This learning process developed through a successive elaboration of social ecological and social articulations related to the expansive functioning of the CoP; and experience of the benefits of rainwater harvesting as radio programme listeners deliberated how the different practices related to their existing knowledge and experience. The study also found that these expansive processes of social learning occurred across the spectrum of smallholder farmers and homestead food growers in a stimulated radio listening focus group discussion. The study concludes that agriculture practitioners involved in education for sustainable development could expand their knowledge sharing platforms by giving more attention to community radio as a means of both involving participants and engaging learning communities in local environment and sustainability concerns.

- Description: Dance has numerous benefits for emotional well-being. For young people specifically it can serve as a prosocial activity where they can engage in a purposeful activity, in a safe space with consistent boundaries and discipline, while surrounded by peers, teachers and positive role models. Recreational spaces that allow young people to feel safe and express themselves is especially important in low socioeconomic areas where there are limited resources and exposure to heightened levels of crime as young people may be less likely to engage in negative behaviours when they have access to alternative, positive activities. This research aimed to explore the lived experiences of a group of young people who participate in dance classes at a community dance project in the Western Cape. The sample group consisted of four young people between the ages of 16 and 20. Semi-structured interviews were conducted with the participants and the interviews were analysed using interpretative phenomenological analysis. Three major themes emerged from the data, namely 1) My exposure to dance - The impact of context, 2) What motivates me to continue attending classes - The fulfilment of the three basic psychological needs, and 3) How does dance make me feel - The experience of emotional well-being through dance. The discussion of the findings yielded many similarities between the experiences of the participants and the relevant literature. Further, it appears that all four participants experience the satisfaction of the three basic psychological needs (competence, autonomy and relatedness) at the centre. This may serve as a motivator to continue attending classes as well as contribute to sustained eudaimonic wellbeing. Recommendations include further studies being conducted with groups of young people engaging in dance projects in different socioeconomic contexts and in different parts of South Africa. This could give us a more rounded understanding of how people young people experience dance class and how it contributes to emotional well-being. Further research could also be conducted with recreational projects that offer other activities in under-resourced areas in order to better inform the development of such recreational activities.

Contemporary Zambian art, conceptualism and the ‘global’ art world

This thesis traces the integration of Africans into the contemporary art community and attributes the process, in part, to a small group of artists of European descent who played a significant role in engaging with Zambians, working side by side with them, subsequently influencing their art production and implicitly shaping the ways in which ‘Zambian’ art ‘ought to’ look for decades to come. The research traces the early days of contemporary art practice in Zambia to the Lusaka Art Society and Art Centre Foundation that was founded and run by an all-settler group of formally trained artists with a particular inclination towards sculpture and painting. In the wake of the integration however, art production in the formalist manner was further proliferated by the European diplomatic community which would also go as far as dictating artistic subject matter. This thesis argues that the Eurocentric and pre-eminently formalist approach to contemporary art has cost Zambian artists an international presence. I submit that the few instances where contemporary Zambian art practice has penetrated the ‘global art’ scene or caught the attention of international curators is due to artists adopting more radical conceptual approaches to art production, often creating tensions with local viewers. This thesis also examines conceptualism in contemporary Zambian art practice and examines the inequalities of the ‘global art’ world. I argue that conceptual art, although not generally accepted on the Zambian art scene, has played a vital role in helping Zambian artists enter the global art world, albeit modestly.

“Oh, you have a ‘she’?”: exploring the lived experiences of black same-sex females living in Grahamstown, South Africa

This inclusion came in 1996 after an oppressive apartheid regime was overcome, also positioning the South African Constitution amongst the more liberal, especially in the wider African context. This inclusion and the contextual disparity has caused curiosity about the realities of same-sex sexualities, especially taking into consideration media reports on violence and perceived social opposition of same- sex sexualities in South Africa. Much of this attention has motivated research studies on same-sex sexualities. Within this research, however, black female same-sex sexualities have been positioned as vulnerable and victimised within the heteronormative context, with much of this research focusing on ‘corrective/curative’ rape. There has however been increasing efforts in moving away from this limiting position by a select few (e.g. Zanele Muholi and Zethu Matebeni) in a more explorative direction in attempts to investigate black female sexualities as complex and expressive rather than passive. This study is an interpretive phenomenological investigation of the lived experiences of black female same-sex sexualities and the plurality of identities that influence their everyday experiences. This took into account intersectionality, heteronormativity and queer theory, which provided a theoretical framework for this study. During the interview process, participants described their experiences as black same-sex females in a variety of contexts including their experiences and influences of external factors (such as family and university. From the results of this research, experiences and identities of participants are presented as complex, fluid, expressive and to some extent political. Participants also expressed the difficulties encountered with misinformed friends and families and describe ways in which they assert themselves within their social and personal contexts.

- Description: Before Namibian independence in 1990, teaching was mostly characterized by teacher-centred pedagogies in which teachers were perceived as the main sources of knowledge. This resulted in learners being passive recipients of such unquestioned knowledge. After independence and to address this, a new educational system was introduced which promoted learner-centred education (LCE) pedagogy. Despite these grand ideals, educational changes in sub-Saharan Africa form a complex issue involving tensions between policy formulation and implementation. This presents Namibian teachers with some challenges in enacting LCE pedagogies. One of these challenges is to find ways to motivate learners and to assist their learning by finding relevant and interesting connections between subject topics and their own experiences and everyday culture outside the classroom. An inability to enact the new curriculum results in learners performing poorly in subjects such as Physical Science. Against this backdrop, this study sought to explore whether or not the integration of traditional music and dance into the design and delivery of lessons on the concepts of echo and waves could influence grade 10 Physical Science learners’ sense making and dispositions towards science. This study was underpinned by an interpretive paradigm. It was informed and guided by the socio-cultural theory as my theoretical framework. The study was carried out with a grade 10 Physical Science class consisting of 30 learners at Lyambombla Combined School (pseudonym) in the Kavango West Region in the northern part of Namibia. Data were generated through diagnostic and summative tests, interviews and lesson observations incorporating traditional music and dance. The findings of the study showed that learners’ sense making and dispositions toward science were positively influenced through traditional music and dance. The study thus recommends the incorporation of indigenous ways of knowing in order to enhance meaning making in science classrooms.

- Description: Before Namibian independence in 1990, teaching was mostly characterized by teacher-centred pedagogies in which teachers were perceived as the main sources of knowledge. This resulted in learners being passive recipients of such unquestioned knowledge. After independence and to address this, a new educational system was introduced which promoted learner-centred education (LCE) pedagogy. Despite these grand ideals, educational changes in sub-Saharan Africa form a complex issue involving tensions between policy formulation and implementation. This presents Namibian teachers with some challenges in enacting LCE pedagogies. One of these challenges is to find ways to motivate learners and to assist their learning by finding relevant and interesting connections between subject topics and their own experiences and everyday culture outside the classroom. An inability to enact the new curriculum results in learners performing poorly in subjects such as Physical Science. Against this backdrop, this study sought to explore whether or not the integration of traditional music and dance into the design and delivery of lessons on the concepts of echo and waves could influence grade 10 Physical Science learners’ sense making and dispositions towards science. This study was underpinned by an interpretive paradigm. It was informed and guided by the socio-cultural theory as my theoretical framework. The study was carried out with a grade 10 Physical Science class consisting of 30 learners at Lyambombla Combined School (pseudonym) in the Kavango West Region in the northern part of Namibia. Data were generated through diagnostic and summative tests, interviews and lesson observations incorporating traditional music and dance. The findings of the study showed that learners’ sense making and dispositions toward science were positively influenced through traditional music and dance. The study thus recommends the incorporation of indigenous ways of knowing in order to enhance meaning making in science classrooms.

Appropriate integration of workers with physical limitations into a manual workplace – development of an assessment tool

In light of this, placement decisions of impaired workers should be based on detailed information of the nature of the jobs available, as well as individual capabilities of the worker. An ergonomics approach to design attempts to achieve an appropriate balance between the capabilities of the worker and the requirements of the task and uses this balance to improve productivity and encourage physical and mental well-being, job satisfaction and safety. A specific analysis tool which can be applied to various workplaces and jobs, and provide information for decisions regarding placement of physically limited workers, will help to increase the percentage of correct placement in an appropriate workplace, resulting in optimum productivity and worker safety. Methods: An assessment tool which allows matching of job requirements and worker capabilities was developed based on a theoretical framework from Mattison and Goebel (2007), as well as principles defined by Almgren and Schaurig (2012) and Demura and Nakada (2010). The tool assesses range of motion, force and time components of the physical requirements of different tasks involved in the job, as well as movement capabilities and limitations of the worker. The tool was pilot tested in a case study with an above the knee amputee working at a research facility. Results: The tool successfully provided information regarding the matching of the work to the identified job. The output of the tool highlighted two tasks which would place the worker at risk due to physical requirements of the tasks being greater than movement capabilities of the worker. These tasks need to be further investigated to determine if accommodations can be made to assist the worker in safely performing the task, or if the job is not suitable for the worker. Conclusions: The tool developed was useful in providing information to inform appropriate placement of the physically limited worker. Further research needs to be done to validate and determine reliability of the tool.

The sedimentology and depositional model of VS5 reef at Beatrix mine and surrounding areas of the Freestate Goldfield, South Africa

Recently, the VS5 placer has emerged to be a significant contributor of ore tonnages mined on the Shaft as mining advances into deeper levels towards the northern portion of the mine lease area. Gold concentration in the VS5 Reef is highly variable from uneconomic, through marginal to economic gold values. A good knowledge of the sedimentological framework of the VS5 Reef was considered necessary in order to interpret the variable distribution of the gold within the VS5 placer. The aim of this study was to determine the depositional environments that played a major role during the formation of the VS5 placer by means of investigating the macroscopic sedimentological parameters of this particular reef. These sedimentological parameters were used as the basis for the subdivision of VS5 Reef into different facies recognized in the mine and surrounding areas. It was recognized that the VS5 placer was formed in a distal, braided fluvial environment by the reworking of the pre-existing Aandenk Reef by new materials containing significant amount of nondurable materials (see definition on page xii) such as shale detritus. Where there is no evidence of reworking of the older Aandenk Reef, the VS5 Reef occurs as poorly sorted, polymictic conglomerate with abundance of non-durable detritus. This is referred to as the Immature (IV) VS5 facies and occurs in the northern portion of the study area. The degree of reworking of the gravel bars by waves and current action resulted in the formation of well sorted, oligomictic conglomerates of the Beatrix facies in the southern portion of the mine. At the boundaries between the Immature VS5 and Beatrix facies occurs the Transitional (Sub-mature) VS5 facies, characterized by reef comprising a polymictic upper portion and a basal more mature oligomictic unit. The Transitional VS5 facies extends across the current central northern mining faces of Beatrix No. 3 Shaft with a northwest-southeast trend. There is a strong correlation between the VS5 lithofacies and distribution of gold mineralization. The Immature VS5 facies is poorly mineralized, with gold values averaging 200 c.m.g/t and lower. The Transitional (Sub-mature) VS5 facies has elevated gold values, ranging from 300 c.m.g/t to 1500 cm.g/t. Mineralization in this unit tend to be bottom loaded as well as at the base of each cyclic unit. The Beatrix facies records the highest grades averaging >1500 cmg/t. The improved understanding of the VS5 lithofacies made it possible to predict gold mineralization and aid planning to mine into viable VS5 areas.

Exploring how teachers mediate learning of experimental techniques using fermentation and distillation of a traditional brew

For instance, in ║Kharas region where the study was conducted, from 2010 to 2016, the overall performance has ranged between 20-40%. Furthermore, according to the results analysis report from the Directorate of National, Examination and Assessments (DNEA), from 2012 to 2016, the ||Kharas region was ranked 11th, 12th, 13th, 14th and 10th in the regional rankings. From the Examiner’s reports, the most poorly answered questions in the National Senior Certificate examinations are those that require learners to explain and show understanding. Additionally, the reports highlighted that learners lack practical skills or lack exposure to experiments and demonstrations to enhance their understanding (Namibia, 20142015). It is against this background that this study sought to explore how teachers mediate learning of experimental techniques using fermentation and distillation of a traditional brew. In particular, the study addressed the following sub-questions:1) what are Grade 11 Physical Science teachers’ perceptions and experiences on the inclusion of indigenous knowledge during Science lessons? 2) What factors influence Grade 11 Physical Science teachers’ perceptions and experiences on the inclusion of indigenous knowledge? 3) How do Grade 11 Physical Science teachers teach experimental techniques conventionally- fermentation and distillation? 4) How does the inclusion of a practical demonstration on making Ombike enable or constrain Grade 11 Physical Science teachers when explaining concepts on experimental techniques - fermentation and distillation? Thus, the focus was on conceptual understanding through linking content to the context of the learners. The study was underpinned by an interpretive paradigm whose focus is on understanding people’s worldviews. Within the interpretive paradigm, a mixed methods (Quant-QUAL methods) case study approach was employed in two sequential phases with Physical Science teachers at one secondary school in Keetmanshoop. Data were collected using document analysis (to strengthen my context). In the first phase, a questionnaire with closed-ended and open-ended questions was used to gather quantitative and qualitative data from 17 Physical Science teachers. Additionally, I conducted interviews with two Physical Science teachers from one Secondary School in Keetmanshoop who were selected based on their expertise, teaching experience and their qualifications. Quantitative data were analysed using frequency tables and graphs. For phase two, lesson and the practical demonstration observations were videotaped and transcribed inductively. Thematic analysis was used to analyse the qualitative data. The study was informed by Vygotsky’s (1978) socio-cultural theory with a focus on the mediation of learning, social interactions and learner engagement within the learners’ Zone of Proximal Development (ZPD) in conjunction with Shulman’s (1987) theory on pedagogical content knowledge (PCK). The findings of the study indicated that the majority of the Physical Science teachers were aware of and supported the inclusion of IK; on the other hand the teachers indicated some challenges that come with IK integration. Some teachers acknowledged the importance of IK, such as the enhancement of understanding, proving of theories, and arousal of interest and context relevance. However, some teachers felt that there are misconceptions in IK that can be carried into the classroom, IK resources like textbooks are not available, and IK is not integrated in the syllabus and examinations and lack of teacher training inter alia.The study recommends that the Ministry of Education, Arts and Culture especially the Division of Curriculum Planning and Development (NIED) needs to explicitly include IK in the Syllabus documents and suggest the inclusion of IK in the textbooks to the publishers to address these challenges. In order to enhance the teaching and learning with IK in Science, it is critical that teachers’ training workshops are conducted and IK resources are designed so that IK integration can be successfully implemented. For that to happen, it is recognized that the teachers’ PCK should be regularly upgraded through Continuous Professional Development (CPD) by the Subject Advisors (SA) so that the teachers are consistently guided on appropriate teaching methodologies and pedagogies about the inclusion of IK.

Thermoluminescence of synthetic quartz annealed beyond its second phase inversion temperature

The aim was to study mechanisms of thermoluminescence in annealed synthetic quartz and to discuss the results in terms of the physics of point defects. The sample was irradiated with a beta dose of 10 Gy of beta radiation and then heated at a linear heating rate of 1 ºC.s-1 up to 500 ºC. The thermoluminescence (TL) glow curve consists of three glow peaks. Peak I at 74 0C (main peak) with high intensity as compared to the other two peaks. Peak II at 144 ºC is more intense than peak III at 180 ºC. This study was on the main peak (MP) at 74 ºC and peak III at 180 ºC. Kinetic analysis was carried out to determine the trap depth E, frequency factor s and the order of kinetics b of both peaks using the initial rise, peak shape, variable heating rate, glow curve deconvolution and isothermal TL methods. The values of kinetic parameters obtained were around 0.7 to 1.0 eV for trap depth and in the interval of 108 to 1015 s-¹ for frequency factor for both peaks. The effect of heating rate from 0.5 to 5 ºC.s-¹ on the TL peak intensity and peak temperature was observed. Also the effect of thermal quenching was observed at high heating rates. Since the TL glow curve has overlapping TL peaks, the Tm-Tstop method from 54 ºC up to 64 ºC and E -Tstop methods were introduced where a first order single peak was observed. Phototransfered thermoluminescence (PTTL) was investigated and characterized by three peaks. First PTTL peak I at 72 ºC, peak II at 134 ºC and peak III at 176 ºC. Analysis was carried out on peaks I and III for the effect of dose dependence from 20-200 Gy. Thermal fading was observed on PTTL peaks I and III, after storage time of 30 minutes.

- Description: International migration is an old phenomenon caused by many factors divided into push and pull factors. However, there is no enough coverage on the perceptions of the labour migrants. Although there is a vast body of writing on migration, this study delves into the experiential perceptions of academic labour migrants at Rhodes University. These academic labour migrants include professors, lecturers, researchers and postdoctoral research fellows. The study took a qualitative approach to document the experiential perceptions of academic labour migrants at Rhodes University. In-depth interviews were conducted with twelve respondents, to analyse how academic labour migrants perceive South Africa’s changing visa policies in the context of regional integration and development, migration networks and choice, host-migrant relations. The study is underpinned by Probsting’s (2015) concept of "spatial fix" in the context of capitalism and migration, to locate the positionality of academic labour migrants within a capitalist society. The study established that the increase in skilled labour migration is relatively linked to the expansion of capitalism. Based on the perceptions of the respondents, the study concluded that migration is inherently vital in providing cheap labour for capitalists. It established that changing visa policies is not without problems. Historical dispositions of the apartheid system, conflicting domestic versus international imperatives, neo-liberal policies and the widely condemned results of capitalism as an imperialist system and other factors influence migration management in South Africa.

- Description: International migration is an old phenomenon caused by many factors divided into push and pull factors. However, there is no enough coverage on the perceptions of the labour migrants. Although there is a vast body of writing on migration, this study delves into the experiential perceptions of academic labour migrants at Rhodes University. These academic labour migrants include professors, lecturers, researchers and postdoctoral research fellows. The study took a qualitative approach to document the experiential perceptions of academic labour migrants at Rhodes University. In-depth interviews were conducted with twelve respondents, to analyse how academic labour migrants perceive South Africa’s changing visa policies in the context of regional integration and development, migration networks and choice, host-migrant relations. The study is underpinned by Probsting’s (2015) concept of "spatial fix" in the context of capitalism and migration, to locate the positionality of academic labour migrants within a capitalist society. The study established that the increase in skilled labour migration is relatively linked to the expansion of capitalism. Based on the perceptions of the respondents, the study concluded that migration is inherently vital in providing cheap labour for capitalists. It established that changing visa policies is not without problems. Historical dispositions of the apartheid system, conflicting domestic versus international imperatives, neo-liberal policies and the widely condemned results of capitalism as an imperialist system and other factors influence migration management in South Africa.

- Description: The Kalahari Manganese Field (KMF) located in the Northern Cape Province about 700km south west of Johannesburg contains 80% of the world manganese ore reserves. Mamatwan Mine is hosted within the low grade Mamatwan type ore and is located in the southernmost tip of the KMF. This mine is an open pit mine which is divided into three benches namely the top cut, middle cut and bottom cut. These three benches are structurally controlled by faults which influence the overall grade of the manganese ore. This study is a follow up work to the previous two studies carried out at Wessels Mine and Mamatwan Mine by (Gutzmer and Beukes) in 1995 and 1996 respectively with regards to alteration processes around fault controlled systems in which they concluded that epithermal fluids caused local reduction and bleaching of ore followed by oxidation and carbonate leaching of manganese ore through ascending oxidized groundwater. Metasomatic activity around fault controlled systems is controlled by three main processes namely redistribution, enrichment and depletion. These processes are determined by mobility/immobility of elements from the fault which are introduced into the pre-existing braunite carbonate rich ore. Elements such as Ca, Mg, Si, Fe, C and Mn interact with pre-existing ore due to temperature, fluid pressure, physico-chemical property of fluid gradient. Structurally, faulting and folding contribute to the movement of elements as one end of the system gets depleted the other end of the system gets enriched and vice versa. To better understand this metasomatic activity, it is crucial to conduct mass balance studies of these elements. Grant (1986) introduced the isocon diagram which is a modification of Gresen’s equation (1967) to ascertain which elements are directly or indirectly related to alteration through enrichment and depletion of Ca, Mg, Si, Fe, C and Mn. As the section approaches from altered to less altered manganese ore the mineral chemistry gradually changes from a manganese rich matrix composed of manganomelane and todorokite to a carbonate rich matrix composed of braunite, dolomite, kutnohorite and Mn-rich calcites.

Intergenerational learning and environmental care: a case of a fishing community next to Africa’s first marine protected area

- Description: This study explored the relationship between intergenerational learning and environmental care in the small fishing community of Covie, located next to the Tsitsikamma Marine Protected Area (TMPA) on the south-eastern coast of South Africa. Since Covie’s establishment as a woodcutter settlement in 1883, the community has depended on the marine and coastal environment such that their communal identity and basic means of subsistence are closely tied to their traditional fishing practices. Since its proclamation in 1964, the TMPA has undergone numerous policy changes, most notably the complete closure of the TMPA to fishing in 2001. Against this backdrop, the study sought to understand how intergenerational learning about fishing practices are mediated in Covie and the ways in which such learning processes constitute a sense of place and belonging for the Covie fishers, and to develop a sense of care for the natural environment. The study included 12 Covie community members of different generations and genders so as to be representative of the community (approximately 86 members). The research was informed by qualitative data generated through a focus group discussion with eight Covie community members, a mirror workshop with the same eight community members, eight semi-structured interviews, and five naturalistic observations of fishing practices. Data generation and analysis was informed by Etienne Wenger’s theory of Communities of Practice which was complemented by theoretical perspectives on intergenerational learning and attachment to place. This study found that the Covie fishers indeed operate as a community of practice who depend significantly on intergenerational learning processes to transfer knowledge, skills and values about fishing practices to younger generations. The 2001 policy changes that denied the Covie fishers access to their traditional fishing sites were shown to reduce the participation in fishing of a range of community members (in particular children and women), which in turn influenced forms of intergenerational learning about fishing. The youth’s reduced participation especially was linked to more protracted and fragmented processes of learning about fishing and Covie’s code of fishing conduct, including its underpinning sense of environmental care. Finally, this study argues that the affective and socio-material connections to their natural surroundings have shaped the Covie community’s sense of care and responsibility toward the environment.

It also analyses various other factors that play a role when judges interpret legislation, in an effort to answer the question to what extent do philosophical theories and interpretative approaches explain the role of judges as interpreters? Jurisprudential theories such as the natural law theory, positivist theories, and American realist theories are used to analyse how judges interpret and how theorists think judges should play their interpretational role. It is noted that in pre-constitutional South Africa the courts followed a positivist paradigm; as a result, the judges used a strict literal approach to interpretation. The new Constitution brought a change in the jurisprudential paradigm accepted in South Africa and has transformed how judges perceive and carry out their role as interpreters of legislation. Judges have now adopted the purposive value-laden approach as authoritative. As custodians of the Constitution, judges should interpret provisions against the values imposed by it. The purposive value-laden interpretational approach allows judges to take into account more considerations and to weigh a provision against the constitutional values. Other issues discussed pertain to how institutional guidelines such as the doctrine of precedent and separation of powers, to a lesser extent, play a role in how judges interpret the law. It is demonstrated that the doctrine of precedent does not limit the role of judges but rather contributes to maintaining certainty, predictability and coherence in the legal system. It is also noted that judicial discretion is the mechanism by which judges use extra-legal factors such as public policy and moral considerations to assist in interpreting legislation.

- Description: This thesis is a case study of how church, land and dispossession of land has influenced identity formation of a coloured community in the Eastern Province, namely the Klipfontein community. Coloured history in the Eastern Province has largely been neglected. This study attempts to rectify such a lack of in-depth enquiry as it may lead to misinterpretations that may influence contemporary politics and identity formation. Through research based on primary sources, it is evident that the social landscape of Klipfontein Farm and the relationships between that community and surrounding black African and white communities have largely been shaped by the stipulations contained in the joint will of the community’s ancestors: Dirk and Sarah Janse van Rensburg. The land devolved into a trust and has been administered by trustees since the death of the first spouse in 1877. By keeping the land in a trust, it enabled the descendants to continue to live on the farm in perpetuity, without the risk of being forced off the land via financial restraints or racially-based legislation. But the usufructuaries could also never fully utilise Klipfontein as an agricultural concern due to a combination of a lack of equipment and skill, and the provisions of the will. These complications inevitably led to inter-familial disputes and tension. Before 1939 there had already been three court cases dealing with the interpretations of the Will. In that same year the Supreme Court ordered that tracts of the land, including a part of Boesmansriviermond village, be sold in order to pay off arrear rates and taxes. Although the responsibility for these sales lay with the trustees, the community has been suspicious of the usufructuaries ever since. A key element of the Klipfontein identity is their religion. The church legitimises their right to the farm - against those who wish to take that right away. Their claim to occupation is couched in scriptural discourse, viewing Klipfontein as 'their Garden of Eden' that God gave to the stamvader, Dirk Janse van Rensburg. This seemed to have been partially successful for the Klipfontein community in staving off harassment by authorities. It also caused friction between the community and the black African residents. Some usufructuaries and family members felt that such right was exclusively given to the coloured community and so they became increasingly annoyed by the black Africans who settled there. Other usufructuaries did not share this feeling. They allowed evicted black African farm labourers to settle on certain portions of Klipfontein until the late 1970s. The black African population rapidly increased due to misinformation and evictions from neighbouring farms. This only further exacerbated the inter-familial conflict between usufructuaries, flaring tensions between the black Africans and their reluctant hosts as well as animosity from the white community towards Klipfontein. In 1979, after a series of court cases, a decision was made to remove all the African settlers by force and relocate most of them to the ‘homeland’ of Ciskei. The rest, who were of ‘working-age’ were left behind in a ‘temporary emergency camp’ on the outskirts of Kenton-on-Sea. The effects of these removals still impact the relationships between the different racial groups in the area to this day.

Credit extension in South Africa: an analysis of the impact of interest rates and income levels on the level of household debt

- Description: The recent growth in the unsecured lending market and the bankruptcy of African Bank Investments Limited have brought to light concerns regarding credit extension and the level of household indebtedness in South Africa. This study seeks to investigate the relevant aspects of credit extension in both the secured and unsecured lending markets by firstly analysing contemporary literature and then conducting a more formal empirical analysis. A VAR model is estimated to examine the effects household disposable income and interest rates have on the level of household debt in South Africa for the period 1995Q1-2015Q3. The empirical results indicate that there is no significant deterministic relationship between household disposable income and household debt. However, the results show that such a relationship does exist between interest rate and household debt. Finally, impulse response functions obtained from the VAR estimation are examined which indicate that both shocks too household disposable income and interest rates effect the level of household debt, but that this effect returns to equilibrium within six periods.

This study seeks to investigate the relevant aspects of credit extension in both the secured and unsecured lending markets by firstly analysing contemporary literature and then conducting a more formal empirical analysis. A VAR model is estimated to examine the effects household disposable income and interest rates have on the level of household debt in South Africa for the period 1995Q1-2015Q3. The empirical results indicate that there is no significant deterministic relationship between household disposable income and household debt. However, the results show that such a relationship does exist between interest rate and household debt. Finally, impulse response functions obtained from the VAR estimation are examined which indicate that both shocks too household disposable income and interest rates effect the level of household debt, but that this effect returns to equilibrium within six periods.
